The Colorado FOP "Non-duty Legal Plan" is available to all members in good standing with any Colorado FOP Local Lodge. The plan is available to members whose Lodge has elected to cover the entire membership, or to individual members in good standing. The plan provides coverage for a range of non duty related legal issues.
The non-duty plan is not part of the Colorado FOP Legal Defense Plan that all members enjoy as part of their FOP membership dues. They are two separate and different plans. This plan is supplemental covering a variety of general legal issues that are not related to your occupation per se. As such the non-duty legal benefit has its own separate structure, terms & conditions, attorneys, and dues schedule. The non-duty plan is optional and offered as a separate elected benefit for all FOP members in good standing.

The Non-Duty Legal Plan
Who Is Covered
- Peace Officers and eligible Public Safety Employees who are FOP members in good standing.
- Active, transferring, and retired members (as long as dues are paid and membership remains active).
Core Benefit
- Up to $15,000 in legal fees and costs per covered off-duty claim, subject to specific caps and exclusions.
- Maximum of $15,000 total coverage per calendar year, even if multiple claims occur.
Covered Legal Areas
1. Criminal Defense
- Misdemeanor and felony off-duty criminal cases
- Includes DUI/DWAI
- Excludes traffic tickets and parking violations
- Coverage cap: $15,000 per claim
2. Employment Law
- Unemployment hearings beyond FOP Legal Defense Fund coverage
- District Court C.R.C.P. 106 administrative reviews
- Excludes matters covered by the FOP Labor Council
- Coverage cap: $15,000 per claim
3. Wills, Trusts & Estate Planning
- Simple wills
- Medical and financial powers of attorney
- Living wills
- Simple trusts and declarations of last remains
- Coverage cap: up to $15,000 per claim (or approved fixed fee)
4. Family Law (Limited Coverage)
- Divorce, child support, maintenance, and parental responsibility matters under Title 14
- Member must first pay $2,500 out-of-pocket
- Plan then covers up to $2,500 total
- Maximum coverage: $2,500 per family law claim
What Costs Are Covered
- Attorney fees
- Court filing fees
- Expert and witness fees
- Transcripts and depositions
- Investigations and records
- Travel, photocopying, postage, and similar litigation expenses (All subject to the applicable claim cap)
Attorney Access
- Representation by FOP-approved attorneys and law firms
- Once coverage limits are reached, members may continue representation at the discounted FOP rate of $220/hour
Affordable Monthly Cost
- $10/month for members whose lodge enrolls all members
Continuity of Coverage
- Retired members remain eligible if dues and lodge membership continue
